We are not an insurance carrier. We act as a licensed agent connecting consumers with insurance products issued by third-party carriers.

References to "Gerard Muhammad Insurance," "we," "us," or "our" in these Terms refer to Direct to You Services LLC and its insurance brokerage operations under the Gerard Muhammad Insurance brand.

2. Eligibility

To use our Website and Services, you must:

3. No Insurance Contract Created

Submitting a quote request, scheduling a call, or speaking with our agents does not create an insurance contract. An insurance contract is created only when:

  • A formal application is submitted to an insurance carrier
  • The carrier approves the application after underwriting
  • The first premium is paid
  • A policy is issued and delivered

Quotes provided through this Website are estimates only. Actual rates depend on age, gender, health, tobacco use, coverage amount, state of residence, and underwriting approval. Rates and availability may change without notice.

4. Agent Compensation Disclosure

Gerard Muhammad Insurance is compensated by insurance carriers when consumers purchase policies through us. This compensation does not increase the cost of your policy. Our recommendations are based on your needs, but you should review any policy carefully and ask questions before purchasing.

5. Use of Website

You agree to use the Website only for lawful purposes and in accordance with these Terms. You may not:

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIRECT TO YOU SERVICES LLC, GERARD MUHAMMAD INSURANCE, GERARD MUHAMMAD, AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, MEMBERS, AND PARTNERS WILL NOT BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, OR USE
  • DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE WEBSITE OR SERVICES

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE WEBSITE WILL NOT EXCEED $100.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

We work with multiple insurance carriers. Each carrier has its own terms, policies, application processes, and underwriting requirements. We are not responsible for the actions, decisions, or policies of any insurance carrier. You should review any carrier's terms and policy documents carefully before purchasing.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles. You agree that any legal action arising out of or relating to these Terms or the Website will be brought exclusively in the state or federal courts located in San Bernardino County, California, and you consent to the personal jurisdiction of those courts.

13. Dispute Resolution

13.1 Informal Resolution

Before filing any formal claim, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. We will work in good faith to resolve any issue within 30 days.

13.2 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Website will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration will be conducted in San Bernardino County, California.

13.3 Class Action Waiver

You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class, collective, or representative action. The arbitrator may not consolidate more than one person's claims.

13.4 Exception

You may bring an individual action in small claims court if the claim qualifies, and either party may seek injunctive relief in court to protect intellectual property rights.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15. Changes to Terms
